Tim has considerable experience in intellectual property dispute resolution. He has acted in over a quarter of all patent matters (and over three quarters of pharmaceutical patent matters) reported in Burrell’s Intellectual Property Law Reports since 2006 (as at 2013).
He has acted in matters before the High Court, the Court of the Commissioner of Patents, the Supreme Court of Appeal, and the Constitutional Court. These matters have included litigation on patents relating to medicines containing fexofenadine, amlodipine besylate, salmeterol/fluticasone propionate combinations, escitalopram, imatinib, emtricitabine (including in combinations with efavirenz and tenfovir), docetaxel, clopidogrel, and perindopril. These matters have also included litigation relating to copyright and trade marks.
Further, Tim has represented clients in proceedings before the complaints directorate of the Advertising Standards Authority, and the appellate tribunal established under the Medicines and Related Substances Control Act 101 of 1965. Tim previously practised as a director at DM Kisch, before moving to Cape Town to join Mallinicks in 2004. Tim joined Brian Bacon Inc. in 2006.
